1. Acceptance of Terms

Share My Pint is operated by John Brandauer. By accessing or using the Share My Pint mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

2. Eligibility

You must be of legal drinking age in your jurisdiction to use this App. For the current all-country, US-compatible submission path, the App requires users to be 21 or older. By using the App, you represent and warrant that you meet this requirement. We verify age during registration.

3. User Accounts

To use certain features of the App, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You retain ownership of the content you post to the App ("User Content"), including photos, ratings, reviews, and comments. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your User Content in connection with operating and promoting the App.

You agree not to post User Content that is:

• Illegal, harmful, threatening, or offensive
• Infringing on the intellectual property rights of others
• Promoting excessive or irresponsible alcohol consumption
• Spam, advertising, or solicitation without permission
• Sexually explicit or violent
• Deliberately misleading or fraudulent

We reserve the right to remove User Content that violates these Terms at our sole discretion.

5. Direct Support and Disabled Digital Purchases

You may voluntarily send a fixed support amount directly to an eligible user through Stripe Connect. Apple Pay and Google Pay may appear as payment methods where supported. A direct-support payment is not a purchase from Share My Pint and does not unlock chips, currency, content, status, a badge, or any other digital feature. Share My Pint does not deduct a platform commission from the support amount.

Recipients must complete Stripe Connect onboarding and remain eligible under Stripe's requirements. The recipient is identified to Stripe as the business of record for the support payment. Stripe may verify identity and bank information, delay or restrict payouts, reject a payment, assess processing/refund/dispute fees, or debit and reverse amounts under the applicable Connect terms. Share My Pint sets no application fee or App commission, but does not promise to absorb every Stripe fee, refund, dispute, reversal, or chargeback cost. An authorised refund must reverse the connected-account transfer and is recorded only after Stripe webhook confirmation. For support questions or refund requests, contact office@sharemypint.com; mandatory consumer rights remain unaffected.

Digital chip purchases, paid digital supporter benefits, business promotion purchases, in-app wallet balances, and user-initiated cash-out flows are disabled. Any future paid digital features must use the App Store or Google Play billing systems where required and must be disclosed before release.

6. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose
• Harass, abuse, or harm another person
• Attempt to gain unauthorized access to the App or its systems
• Use automated means to access the App (bots, scrapers)
• Interfere with or disrupt the App or its servers
• Impersonate any person or entity
• Collect information about other users without their consent
• Circumvent the age verification system

7. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Share My Pint and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.

8. Third-Party Services

The App integrates with third-party services including Supabase, Stripe Connect, Google Maps, public OpenStreetMap Overpass instances, Sentry, Expo, Apple Sign In, and Google Sign-In. AI image analysis and paid digital features are disabled in release 1.2; Stripe is used only for voluntary direct support. Third-party processing is described in the Privacy Policy and may also be subject to the provider's terms and privacy policy.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

In no event shall Share My Pint, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, including but not limited to loss of profits, data, or other intangible losses.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Share My Pint and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will cease immediately.

13. Governing Law

These Terms are governed by applicable law. Nothing in these Terms excludes mandatory consumer protections or a jurisdiction that cannot lawfully be excluded.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

15. Responsible Drinking

Share My Pint promotes responsible drinking. The App is a social platform for sharing beverage experiences and is not intended to encourage excessive alcohol consumption. If you or someone you know needs help with alcohol, please contact your local support services.
